UFA Declared Unconstitutional — Legal Appeal Underway

By now, many of you have likely heard the disappointing news: 3rd District Court Judge Laura Scott ruled in favor of the Utah Education Association (the teachers' union), declaring the Utah Fits All Scholarship Program unconstitutional. We strongly disagree with this decision. Read our Press Release HERE.
We understand that many parents have questions about what comes next and how this ruling may impact both current and future scholarship recipients. While we don’t have all the answers yet, please know that we are in ongoing communication with our legislators, the USBE Department of Operations, and the Institute for Justice attorneys defending the program. We are committed to keeping you informed as new information becomes available and will provide updates following the status conference scheduled for this Wednesday.

➡️ The Attorney General’s office is representing the state in defense of the program.
➡️ The Institute for Justice (IJ) represents two families who intervened to defend the program when the lawsuit was filed. Read their Press Release HERE.
➡️ This Wednesday at 2pm a status conference will be held with the Judge and attorneys to receive more information about the ruling.
➡️ Attorneys defending the program will request a stay on Wednesday to allow the program to continue through the appeal process.
➡️ The Judge could issue either a stay or an injunction. An injunction would immediately halt the program. We are hopeful the Judge will render a stay.
➡️ Attorneys will immediately be filing an appeal to the Utah Supreme Court — we do not yet know the timeline for when the case will be heard.
